    1.INTRODUCTION

    Welcome to RockstarTrader. These Terms of Use ("Terms") govern your access to and use of the RockstarTrader platform, including all tools, features, content, and services available at rockstartrader.com (the "Platform").

    By accessing or using the Platform in any way, you confirm that you have read, understood, and agree to be legally bound by these Terms in their entirety. If you do not agree, you must immediately cease using the Platform.

    The Platform is operated by RockstarTrader ("we", "us", "our", or "RockstarTrader").

    2.ELIGIBILITY

    By using the Platform, you represent, warrant, and confirm that:

    • You are at least 18 years of age and have full legal capacity to enter into a binding agreement.
    • Your use of the Platform does not violate any applicable law or regulation in your jurisdiction.
    • You are not located in, nor a citizen or resident of, any jurisdiction where access to the Platform or participation in financial markets is legally prohibited.
    • You are accessing the Platform for your own personal, non-commercial use only, unless expressly agreed otherwise in writing by RockstarTrader.

    3.DESCRIPTION OF SERVICES

    RockstarTrader is a trading analytics, performance tracking, and market intelligence platform. The Platform includes, but is not limited to:

    • Weekly systematic momentum stock selections (the "Rockstar Stocks" strategy), presented as informational market intelligence only.
    • Live and historical strategy performance tracking and equity curves.
    • Risk management calculators and trade sizing tools.
    • Personal trade journaling, performance analytics, and portfolio tracking.
    • Market data dashboards, analyst ratings, technical analysis tools, and economic calendars.
    • Educational content, blog articles, and AI-assisted coaching features.

    We reserve the right to modify, suspend, or discontinue any feature or service at any time and without prior notice. We shall have no liability to you or any third party for any such modification, suspension, or discontinuation.

    Please read this section carefully. It directly affects your legal rights.

    Nothing on the RockstarTrader Platform — including but not limited to the weekly Rockstar Stocks selections, performance data, equity curves, market intelligence dashboards, analyst ratings, technical indicators, AI-generated content, blog articles, or any other tools or outputs — constitutes financial advice, investment advice, trading advice, portfolio management, or any other form of regulated financial guidance or service.

    All content, data, tools, scores, analyses, and outputs are provided strictly for informational and educational purposes only. They reflect automated, rules-based analysis and are not tailored to your individual financial circumstances, investment objectives, or risk tolerance.

    The weekly Rockstar Stocks list is not a recommendation to buy, sell, or hold any security. It is a systematic, algorithmic output based on defined technical criteria. You must make your own independent investment decisions and bear sole responsibility for all trades you execute.

    Trading financial instruments — including stocks, options, futures, CFDs, and other derivatives — involves substantial risk of loss. You may lose some or all of your invested capital. Past performance data shown on the Platform, including all historical strategy returns, does not guarantee, predict, or imply future results.

    RockstarTrader is not a licensed financial advisor, broker-dealer, registered investment advisor, or regulated financial entity in any jurisdiction. If you require personalised financial advice, please consult a qualified, licensed financial professional in your jurisdiction before making any investment decisions.

    5.PERFORMANCE DATA — SPECIFIC DISCLAIMERS

    The Platform displays live-tracked and historical strategy performance results. You acknowledge and agree to the following:

    5.1 Tracked Results, Not Guaranteed Returns

    All performance figures displayed represent the results of a systematic, algorithmic strategy applied to actual historical market prices. These results are provided for informational purposes only and do not represent the actual returns of any managed fund, investment product, or client account.

    5.2 Individual Results Will Differ

    Your actual trading results may differ materially from published strategy performance due to, without limitation: differences in trade execution timing, slippage, brokerage commissions, margin requirements, tax obligations, capital size, position sizing choices, human error, technical failures, or market conditions at the time of your trades.

    5.3 No Warranty on Data Accuracy

    Performance data is computed from market prices sourced from third-party data providers. While we strive for accuracy and operate integrity-verification systems, we make no warranty that the data is free from errors, omissions, delays, or technical inaccuracies. Market data is inherently subject to revision, and you should always verify data independently through your broker or other authoritative sources.

    5.4 No Reliance

    You agree that you will not rely solely on Platform performance data as the basis for any trading or investment decision. By using the Platform, you confirm that you understand these limitations and accept full responsibility for any decisions made using Platform information.

    6.ACCOUNT REGISTRATION

    To access certain features, you must create an account. By registering, you agree to:

    • Provide accurate, current, and complete information during registration and keep it updated.
    • Maintain the security and confidentiality of your login credentials.
    • Notify us immediately at hello@rockstartrader.com of any unauthorised access to or use of your account.
    • Accept full responsibility for all activity that occurs under your account, whether or not authorised by you.

    We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, for any reason including suspected violation of these Terms, fraudulent activity, or conduct that may harm the Platform or other users.

    7.SUBSCRIPTION PLANS AND BILLING

    7.1 Plans

    RockstarTrader offers a Free tier and a Pro tier. The Pro tier is available at USD 49 per month or USD 470 per year. Features available under each tier are subject to change at our discretion.

    7.2 Billing and Payment

    All payments are processed securely through Stripe. By subscribing, you authorise recurring charges to your payment method at the applicable rate until you cancel. Subscription fees are charged in advance. Prices are listed in EUR and exclude applicable taxes, which are your sole responsibility.

    7.3 No Refund Policy

    All subscription payments are final and non-refundable.

    We do not offer refunds, credits, or pro-rata adjustments for any reason, including but not limited to: cancellation mid-cycle, unused features, platform downtime, dissatisfaction with strategy performance, or changes to Platform features. By subscribing, you explicitly acknowledge and accept this no-refund policy.

    7.4 Cancellation

    You may cancel your subscription at any time via your account settings. Access continues until the end of the current billing period, after which the account reverts to the Free plan. No partial refund will be issued.

    7.5 Price Changes

    We may change subscription pricing at any time. We will provide at least 30 days written notice before any price change takes effect for existing subscribers. Continued use of the Platform after the effective date constitutes acceptance of the revised pricing.

    8.ACCEPTABLE USE POLICY

    You agree not to engage in any of the following prohibited activities:

    • Using the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
    • Sharing, sublicensing, reselling, or otherwise redistributing your account access, login credentials, or any Platform content (including the weekly Rockstar Stocks list) to any third party, whether for commercial gain or otherwise. Each subscription is strictly for individual use by the registered account holder only.
    • Scraping, crawling, or extracting data from the Platform using automated means, bots, scripts, or any other technology, without our prior written consent.
    • Reproducing, distributing, publishing, or commercially exploiting any content, data, tools, or features of the Platform without our express written authorisation.
    • Attempting to gain unauthorised access to any part of the Platform, its underlying systems, databases, or infrastructure.
    • Interfering with or disrupting the integrity, availability, or performance of the Platform or its underlying infrastructure.
    • Using the Platform to publish or transmit any content that is unlawful, harmful, defamatory, or infringing on the rights of any third party.

    We reserve the right to immediately terminate your account and pursue all available legal remedies in the event of any violation of this Section 8.

    9.INTELLECTUAL PROPERTY

    All content, features, design, code, algorithms, trademarks, trade names, logos, and materials on the Platform are the exclusive property of RockstarTrader or its licensors and are protected by applicable intellectual property laws worldwide.

    The Rockstar Stocks selection algorithm, momentum ranking methodology, performance tracking system, and all associated analytical outputs are proprietary intellectual property of RockstarTrader. Any reverse engineering, copying, or reproduction of these systems or outputs is strictly prohibited.

    You retain ownership of personal data, trade journal entries, and other personal content you submit. By submitting such content, you grant us a limited, non-exclusive licence to process and store it solely to provide the services described herein.

    10.PLATFORM AVAILABILITY AND DATA ERRORS

    We operate the Platform with a high standard of care and have implemented automated systems to maintain data accuracy and availability. However, you acknowledge and agree that:

    • The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or secure access at all times.
    • Market data displayed may be subject to delays, inaccuracies, or omissions resulting from third-party data provider failures. We are not responsible for any losses arising from reliance on such data.
    • Scheduled automation (including weekly stock scans, performance updates, and settlement calculations) may be delayed or disrupted due to technical failures, third-party API outages, or market disruptions. We will endeavour to resolve such issues promptly but accept no liability for any resulting losses.
    • Any prices, returns, or performance data shown on the Platform should be verified against your own broker data before making any trading decisions.

    Under no circumstances shall Platform downtime, data errors, delayed data, or technical failures create any obligation or liability on the part of RockstarTrader to compensate you for any trading losses or missed opportunities.

    11.THIRD-PARTY DATA AND SERVICES

    The Platform sources market data from third-party providers including Yahoo Finance and Financial Modeling Prep (FMP). We do not guarantee the accuracy, completeness, timeliness, or reliability of any third-party data. Such data is provided for informational purposes only.

    The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party site. Accessing third-party sites is entirely at your own risk.

    12.DISCLAIMERS

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM AND ALL CONTENT, DATA, TOOLS, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, TITLE, OR NON-INFRINGEMENT.

    We expressly disclaim any warranty that: (a) the Platform will be uninterrupted, timely, secure, or free of errors; (b) any information or data obtained through the Platform will be accurate or reliable; (c) any defects will be corrected; or (d) the Platform or its servers are free from viruses or other harmful components.

    13.LIMITATION OF LIABILITY

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROCKSTARTRADER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY OF THE FOLLOWING, REGARDLESS OF THE FORM OF ACTION OR THE THEORY OF LIABILITY:

    • Any trading losses, investment losses, or loss of profits arising directly or indirectly from your use of, or reliance on, any information, data, or feature of the Platform — including the weekly Rockstar Stocks selections.
    • Any indirect, incidental, special, consequential, or punitive damages of any kind.
    • Any loss of data, loss of revenue, business interruption, or loss of anticipated profits.
    • Any errors, inaccuracies, omissions, or delays in market data or Platform content.
    • Any failure or interruption of the Platform, including scheduled automation, data feeds, or performance tracking systems.

    In no event shall our total aggregate liability to you for all claims arising from or related to your use of the Platform exceed the total subscription fees paid by you to RockstarTrader in the three (3) months immediately preceding the event giving rise to the claim. This limitation applies even if we have been advised of the possibility of such damages.

    14.INDEMNIFICATION

    You agree to indemnify, defend, and hold harmless RockstarTrader and its officers, directors, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your infringement of any third-party rights; or (e) any trading losses or disputes arising from your investment decisions made using Platform information.

    15.DATA AND PRIVACY

    Your use of the Platform is governed by our Privacy Policy, incorporated by reference. By using the Platform, you consent to the collection, storage, and processing of your data as described therein.

    User data is stored on servers in the United States. By using the Platform, you consent to the international transfer and storage of your data.

    We will never sell your personal or trade data to third parties. Your data is used solely to operate and improve the Platform.

    16.MODIFICATIONS TO THESE TERMS

    We reserve the right to update or modify these Terms at any time. For material changes, we will notify registered users via email or in-Platform notification. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms. If you do not agree to any revised Terms, you must stop using the Platform and cancel your subscription.

    17.TERMINATION

    We may suspend or terminate your access at any time, with or without cause and with or without notice. Termination does not entitle you to any refund. Upon termination, all licences granted under these Terms will immediately cease. You may close your account at any time via account settings or by contacting hello@rockstartrader.com.

    18.GOVERNING LAW AND DISPUTES

    These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts of the UAE.

    Before initiating any formal legal proceedings, you agree to first contact us at hello@rockstartrader.com and attempt to resolve the dispute in good faith within 30 days.

    19.GENERAL PROVISIONS

    19.1 Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and RockstarTrader regarding your use of the Platform and supersede all prior agreements or understandings.

    19.2 Severability

    If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

    19.3 Waiver

    Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision in any subsequent or other instance.

    19.4 Assignment

    You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction.
